PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-07 <br />RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR <br />C. JERRY HINKSTON AS FILED UNDER CASE UP-87-1 <br />WHEREAS. C. Jerry Hinkston has applied for a conditional use <br />permit to operate an automobile sales and rental <br />facility to be located on an approximately 0.85 acre <br />site located on the southeast corner of the intersection <br />of Old Santa Rita Road and Rosewood Drive; and <br />WHEREAS, at their duly noticed public hearing of January 28, 1987 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accordance with the <br />objectives of the Municipal Code and the purposes of the <br />district in which the site is located. The purpose of <br />the CS Zoning District is to accommodate uses that are <br />not otherwise compatible with residential, neighborYiood <br />and business park uses. The site is located adjacent to <br />to other similar existing and proposed uses to the east <br />and south, and separated from the AT&T site to the west, <br />by the Tassajara Creek and Old Santa Rita Road, thereby <br />minimizing the potential conflicts that might arise with <br />dissimilar uses. Such a location is appropriate for the <br />use; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the <br />vicinity. The subject site is located within an area <br />that has sufficient street capacity and services to <br />accommodate the use. Attention has been given to the <br />project design in order to assimilate the use with the <br />surrounding similar uses to the maximum extent possible. <br />The use would adhere to the requirements of the City <br />Building, Engineering and Fire Departments; and <br />WHEREAS, the proposed conditional use will comply with each of <br />the applicable provisions of the Ordinance Code. The <br />proposed rental/sales automobile operation complies with <br />all applicable provisions of Title 18 of the Pleasanton <br />Municipal Code; and <br />- 1 - <br />
