SAVCO DEVELOPMENT DEFERMENT AGREEMENT <br />THIS DEVELOPMENT DEFERMENT AGREEMErT (the "Agreement") is made <br />this 24th day of January ,1984 by and between SAVCO <br />CONSTRUCTION COMPANY, a partnership (hereinafter referred to <br />as "Developer") and the CITY OF PLEASANTOrd, a municipal corporation <br />(hereinafter referred to as "City"). <br />R E C I T A L S <br />A. Developer is the owner of certain property on Foothill <br />Road commonly known as Parcel A, Parcel Map 2293, shown on <br />Exhibit "A" attached hereto and incorporated herein (the "Property"). <br />B. Castlewood Enterprises purchased twenty-one (21) sewer <br />connection permits for property located at Foothill Road and <br />Bernal Avenue consisting of eighteen (18) acres. That parcel <br />later became Parcel ~Iap 2293. (Developer is aware that within <br />the area of the original Parcel Map 2293 only twenty (20) parcels <br />have been approved. Developer is also aware that the twenty-first <br />(21st) sewer permit will therefore expire and be reallocated by <br />the City as of April 6, 1984.) <br />C. Developer subsequently purchased the Property from <br />Castlewood Enterprises including four (4) D.U.E. (Dwelling Unit <br />Equivalent) sewer system connection permits for use in development <br />of the Property, said permits having been issued by the Dublin-San <br />Ramon Services District ("DSRSD") pursuant to Alameda County <br />Superior Court Order in Civil Action No. 42.3134 filed December 19, <br />1972 (the "Court Order"). <br />-1- <br />
