D. Pursuant to the 1972 Court Order, building permits <br />must be obtained within three (3) years after. purchase of any <br />sewer system connection permits, or such sewer permits shall <br />be canceled. This three-year period shall be measured from <br />April 6, 1981, which is the date all LAVW;4A outfall conditions <br />were removed in the EBDA Line. <br />E. Paragraph 8 of Exhibit B to the Agreement, attached <br />to and incorporated in the 1972 Court Order,- provides that where <br />an owner/developer is precluded from obtaining the necessary <br />building permits for a specified period of time by reason of <br />action by a governmental agency, the three-year deadline for <br />obtaining building permits will be extended for an amount of <br />time equal to the time specified in the written contract. <br />F. Due to delays over which Developer had no control <br />resulting from procedural delay and utility locational problems <br />in processing proposed Parcel Map 3612, the project on the <br />subject property has been set back one year. Additionally, <br />because of Pleasanton's desire to see construction take place <br />at reasonable intervals, it is in the vublic interest that <br />the parties agree that none of the four (4) subject building <br />permits will be issued prior to January 24, 1985. Based <br />upon the foregoing, it is the intent of the parties that the <br />expiration date for the four (4) D.U.E. sewer system connection <br />permits on the Property shall be extended a total of two years. <br />NOW, THEREFORE, in consideration of the mutual promises <br />below and the sum of Five Hundred Dollars ($500.00) being paid <br />to Pleasanton as a processing fee concurrently herewith, the <br />-2- <br />
