REIMBURSEMENT AGREEMENT FOR CONSTRUCTION OF <br />INFRASTRUCTURE RELATED TO THE CONVERSION OF OVERHEAD <br />UTILITIES TO UNDERGROUND AS PART OF THE "UNDERGROUND <br />UTILITY DISTRICT 02-01" <br />THIS AGREEMENT is entered into at Pleasanton, California, this~~~tlG/-cam <br />day of~/i u~(~2004, between the City of Pleasanton, a general law city, ("City") <br />and the Property Owner ("Owner"), concerning the property located at <br />yzZ3 ~lev `/Z ?, F ,es~ S'- ("the Property»). <br />Recitals <br />A. The City adopted by resolution (no. 02-138) the formation of <br />Underground Utility District No. 02-01 ("the District"), which <br />provides for the undergrounding of overhead utilities within the <br />District. <br />B. Although the City has approved the use of "Rule 20A" monies to <br />fund eligible portions of work on private property, there will still be <br />a need by property owners to pay for certain construction costs to <br />convert the overhead utilities to underground. <br />C. It is the Owner's financial obligation to have the conversion of <br />overhead utilities within his/her property performed in conjunction <br />with the conversion of the overhead lines to be performed by the <br />utility companies. <br />D. The City and Owner realize that there is a mutual benefit by entering <br />into this agreement in that Owner may realize a potential cost <br />savings due to the economy of scale of the work being performed by <br />one contractor for 40 to 50 properties within the District; and the <br />City will realize a benefit in that coordination efforts will be reduced <br />to a single contractor versus multiple contractors for each property <br />owner within the District. <br />E. Heretofore, Owner has granted to City (and its contractor) access to <br />the Property via aright-of-entry. <br />NOW, THEREFORE, for the consideration expressed herein, it is agreed as <br />follows: <br />U:\A TO G\First Street Rule 20A\Draft Reimbursement Agreement with Roush and Phil's Comments.doc <br />
