1. Contractor to Construct Improvements. Owner shall have the <br />City's electrical contractor convert the overhead utilities on the <br />Property to underground ("the Improvements"). <br />2. Owner to Reimburse City. The cost to City for the work on the <br />Property is estimated to exceed the funds available for the <br />Property under Rule 20A, in the amount set forth in the attached <br />Exhibit A. Owner shall reimburse the City for such costs as <br />provided in paragraph 3. If the contractor's bid exceeds the <br />attached estimate, Owner will be allowed to review the bid <br />received and within seven days either object to or accept the bid. <br />If Owner objects to the bid, Owner shall assume all <br />responsibility to convert the utilities on the Property and a <br />licensed electrical contractor shall perform such work. <br />3. Payment Made When Work is Completed. Upon completion of <br />the work by the City's contractor, City shall invoice Owner for <br />the costs in excess of the Rule 20A funds available for the <br />Property and Owner shall reimburse the City within 60 days <br />thereafter. <br />4. Ownership of the Improvements. When in the City Engineer's <br />judgment the work is completed, the Improvements on private <br />property will become the property of the Owner and the Owner <br />shall be responsible thereafter for any maintenance or alterations <br />thereof. <br />5. Inspection. City will inspect all of the work being performed <br />through an inspector employed by City and at the cost and <br />expense of the City. Owner acknowledges that a right of entry to <br />the Property has been executed, is on file with the City Clerk <br />and provides legal access to the Property by the City's <br />contractor and inspectors. <br />6. Notices. All notices herein required shall be in writing and shall <br />be delivered by mail, postage prepaid.
