DEVELOPMENT DEFERI~?ENT AGP.EEP^ENT <br />Pleasanton Park business Center <br />T~:IS DEVELOPI~NT DEFERrIF;NT AGREEMEIIT is made and entered <br />into by and between DELTA PP.OPEP.TIES, a general partnership <br />("Delta"), and the. CITY OF PLEASANTON, a municipal corporation <br />(~~City.~) <br />R E C I T A L S <br />A. Delta is the owner in fee of certain unimproved <br />real property located in Pleasanton, California, designated <br />as Lots 11 and 12 of Tract 4788, as shoom in Exhibit "A", <br />attached to this agreement and incorporated herein. <br />B. Gn February 24, 1981, City approved a development <br />plan for Pleasanton Park Business Center, designated as PUD- <br />80-14, and subsequently approved a final subdivision map <br />designated Tract 4788 and recorded in Alameda County on <br />January 7, 1982, containing the subject parcels, Lots 11 and <br />12. <br />C. Delta has purchased and now has outstanding sixty <br />(60) U.U.E. (Dwellir_g L'nit Equivalent) sewer system connection <br />permits for use in development of Lots 11 and 12, such <br />permits having been issued by the riublin-San Pamon Services <br />District pursuant to Alameda Gounty Superior Court Orders in <br />Civil Action No. 423134. These permits, bearing Permit <br />No. ~:~59, were issued to Flying J, P_elta's predecessor in <br />interest on September 25,.1979 as part of 130 P.U.F. sewer <br />system connection permits purchased for the entire Bract <br />-1- <br />
