' 47=88 property ar. Delta has succeeded to th~:se permits pursuant <br />to the terms of the-court orders. <br />D. Pursuant to the court orders, building permits must <br />be obtained within three (3) years after purchase of any <br />sewer system connection permits, or such permits shall be <br />canceled; however, if an owner/builder is precluded from <br />obtaining building permits for a specified period of time by <br />reason of the action of a governmental agency, the three- <br />- year deadline for obtaining building permits will be extended <br />for an amount of time equal to the time obtaining building <br />permits has been precluded. <br />E. Delta has developed portions of Tract 4788, using <br />some of the sewer system capacity purchased for the site, <br />and has intended and does intend to develop Lots 11 and 12, <br />thereby using the remaining sixty (60) D.U.E. sewer system <br />connection permits. In the past few weeks, as a result of <br />the review and approval of a 1:",ajor development plan for land <br />on the opposite side of Hopyard P,oad, Pleasanton has requested <br />Delta to redesign the street system for .said Tract and to <br />authorize changes in the construction now underway. It is <br />mutually recognized that said redesign of rights-of-way and <br />halt in scheduled street construction will effectively <br />preclude construction on Lots 11 and 12 of Tract 4788 to <br />which sixty (60) D.U.E. sewer system connection pern~its <br />(the "Sewer Permits") issued by the Dublin San P,amon Services <br />Distroct are now allocated. <br />F.
