REIMBUR.SII~SENT AGREEI~NT FOR INSPECTION SERVICES OF <br />GOLDEN EAGLE FARM RESERVOIR AND TET•~'~'QY SYSTEM <br />THIS AGREEMENT is entered into at Pleasanton, California <br />this 19th day of February 1991, by and between the CITY OF <br />PLEASANTON, a general law city located in Alameda County, <br />California ("City") and GOLDEN EAGLE FARM, a California <br />corporation ("Developer") with reference to the following facts. <br />A. Developer is the owner of certain real property in the <br />City of Pleasanton, County of Alameda, State of California, <br />commonly known as "Golden Eagle Farm," APN 946-3945-4050 and 946- <br />3945-4051 (the "Property"). Developer has obtained City approval <br />of a tentative subdivision map for a 210 unit single-family <br />residential project to be constructed on the Property. <br />B. In connection with construction described above, <br />Developer is required to construct a water reservoir and <br />telemetry system. <br />C. City desires to contract directly with Bissell & Karn, <br />Inc., for specialized inspection services, shop drawing review, <br />and related documents for Golden Eagle Farm reservoir and <br />telemetry system. <br />NOW, THEREFORE, IT IS AGREED as follows: <br />1. Work. Developer is constructing the Golden Eagle Farm <br />reservoir and telemetry as per plans and specifications approved <br />by the City Engineer. As part of the construction, City desires <br />to contract directly with its consultants to complete shop <br />drawing review, assist in change orders, periodic inspection, <br />prepare as-built drawings, and prepare operation and maintenance <br />manuals. <br />2. Reimbursement. Developers agree to reimburse City for <br />all costs for all work described in Paragraph 1 above. No <br />overhead shall be charged by the City. Developer shall make <br />payment to the City within thirty (30) days after the receipt of <br />invoices from City. <br />3. Amount. Developers shall pay the City a total amount <br />not to exceed Thirty-One Thousand Dollars ($31,000) for the work <br />described in Paragraph 1. <br />4. Term. This Agreement shall remain in effect until such <br />time as the Golden Eagle Farm reservoir and telemetry system is <br />completed and accepted by the City. <br />- 1 - <br />
