AGREEMENT <br />THIS AGREEMENT is executed as of June 14, 1983, by and <br />between FOOTHILL ASSOCIATES, a joint venture composed of New <br />England Mutual Life Insurance Company, a Massachusetts corpora- <br />tion, and Canyon Associates, a California general partnership, <br />(hereinafter referred to as "Foothill"), and THE CITY OF <br />PLEASANTON, a municipal corporation (hereinafter referred to <br />as "City"). <br />D~'!'TTAT C <br />A. City has undertaken to construct certain public <br />improvements as part of Assessment District No. 1982-1, <br />(Dublin Canyon Road Improvements) including the widening of <br />Canyon Way adjacent to Foothill's Centerpointe development <br />(hereinafter referred to as "Centerpointe") located at the <br />northeast corner of Canyon Way and Foothill Road. <br />B. Centerpointe is currently under construction <br />pursuant to City approval granted for Case Z-81-117 and <br />Case Z-82-160. Centerpointe includes several buildings which <br />are under construction and a future building pad (hereinafter <br />referred to as "Pad A") for which no final design approval <br />has been granted and no building permit has been issued. All <br />parking and landscaping for the entire development is being; <br />constructed in conjunction with the buildings now under <br />construction, including the parking and landscaping necessary <br />for the future development on Pad A. <br />-1- <br />
