=~ ~ ! <br />LONG-TERM AGREEMENT <br />THIS LONG-TERM AGREEMENT is made and entered intro on the <br />27th day of September, 1983, by and between FIRST PLEASANTON <br />INVESTORS (hereinafter referred to as "Developer") and the CITY <br />OF PLEASANTON, a municipal corporation, (hereinafter referred <br />to as '°City"). The Developer and City agree as set forth below. <br />W I T N E S S E T H <br />:WHEREAS, Developer is the owner of real oroperty in the <br />City of Pleasanton which consists of Parcel A o_f Tract 5129. <br />Parcel A of Tract 5129 consists generally of 14.97 acres <br />located easterly of the existing terminus of West Las Positas <br />Boulevard.: Tract 5129 also includes approximately twelve (I2) <br />acres subdivided into 49 single-family lots; and <br />WHEREAS, Developer is seeking. growth management approval <br />.for Parcel A of.Tract 5129 under the City's Growth :Management <br />Program; ..and <br />.WHEREAS, City may enter long-term .agreements with project <br />developers meeting the requirements for such agreements pursuant <br />to Ordinance No. 1023 .(Growth Management Program) and the imple- <br />menting procedures contained in Resolution No. 82-66; and. <br />WHEREAS, City and Developer wish to enter into a long-term <br />agreement in order 'to achieve the benefits of the Project to <br />City and its residents. while maintainin; conformity with the <br />.City's General .Plan growth policies; <br />NOW, THEREFORE, the City and Developer hereby agree as follows: <br />-1- <br />
