<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-21 <br />RESOLUTION RECOMMENDING THAT THE CITY COUNCIL ADOPT THE CEQA <br />FINDINGS AND THE STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE <br />BERNAL PROPERTY PHASE II SPECIFIC PLAN/BERNAL COMMUNITY PARK MASTER <br />PLAN PROJECT, AND APPROVE THE BERNAL PROPERTY PHASE II SPECIFIC PLAN <br />AND THE RELATED MITIGATION MONITORING AND REPORTING PLAN <br />WHEREAS, the City is considering adoption o£ (1) the Draft Bernal Property Phase II <br />Specific Plan fora 318--acre portion of the greater 516-acre Bernal Property, <br />located south of Bernal Avenue along both sides of I-680; and (2) the Draft Bernal <br />Community Park Master Plan for approximately 50 acres of land within the <br />Phase II Specific Plan Area (collectively the "Project"); and <br />WHEREAS, the City has prepared a draft Specific Plan for the 318-acre portion of the Bernal <br />Property; and <br />WHEREAS, the proposed Specific Plan calls for a variety of public facilities, open space, trails <br />and other recreational amenities, as set forth more particularly in the attached <br />Exhibit A, and as amended pursuant to the attached Exhibit B; and <br />WHEREAS, the City, acting as the lead agency under the California Environmental Quality Act <br />(CEQA), determined on March 5, 2005 that an Environmental Impact <br />Report (EIR) was required for the Project and referred a Notice of Preparation of <br />an EIR to all affected/interested agencies, organizations, and persons on <br />August 29, 2005; and <br />WHEREAS, the City conducted an environmental scoping meeting on September 7, 2005 for <br />members of the public to provide comments on items to be addressed in the EIR; <br />and <br />WHEREAS, the City prepared a Draft EIR for the Project which was published on February 1, <br />2006 and provided proper legal notice of document preparation and availability; <br />and <br />WHEREAS, the Planning Commission held a noticed public hearing on February 22, 2006 to <br />accept comments on the Draft EIR during the forty-five day review period, and the <br />City also accepted and responded to comments to the Draft EIR received from <br />public agencies having jurisdiction by law, persons having special expertise with <br />respect to any environmental impacts involved, and other persons and <br />organizations having an interest in the Project; and <br />
