Resolution No. PC-2006-21 Page Two WHEREAS, the Final EIR for the Project was prepared and contains the Draft EIR, comments and recommendations received on the Draft EIR, and the responses to comments raised regarding environmental issues in the review and consultation process; and WHEREAS, the City provided proper notice of completion of the Final EIR, and the Planning Commission held a noticed public hearing on April 26, 2006, regarding the Final EIR and the proposed Draft Specific Plan and considered all public testimony, relevant exhibits, and recommendations of City staff; and WHEREAS, on April 26, 2006, the Planning Commission found the Final EIR to be complete and adequate for the Project and recommended to the City Council that the Final EIR be certified. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1: Recommends that the City Council adopt the attached CEQA Findings and Statement of Overriding Considerations (Exhibit C prepared for the Project. Section 2: Recommends that the City Council find that the proposed Bernal Property Phase II Specific Plan, as amended, is consistent with the General Plan and the Bernal Property Phase I Specific Plan. Section 3: Recommends that the City Council adopt the Bemal Property Phase II Specific Plan, dated January 2006, attached as Exhibit A, as amended per the attached Exhibit B. Section 4: Recommends that the City Council adopt the Mitigation Monitoring and Reporting Plan, attached as Exhibit D, for the Project. Section 5: This resolution shall become effective immediately upon its passage and adoption. THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON ON THE 26TH DAY OF APRIL 2006 BY THE FOLLOWING VOTE: AYES: Commissioners Arkin, Fox, Maas, Pearce, and Roberts.
