PC-2006-23
RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF
KAZUO AND TAKIKO HATSUSHI FOR PUD DEVELOPMENT PLAN APPROVAL,
AS FILED UNDER CASE PUD-99-14
WHEREAS, Kazuo and Takiko Hatsushi have applied for PUD development plan approval of a new
klevelopment consisting of 13 new single-family homes and one existing single-family
home on an approximately 15-acre site located at 2756, 2770, and 2798 Vineyard
Avenue, in the Vineyard Avenue Corridor Specific Plan Area; and
WHEREAS, zoning for the property is PUD-LDR and OS (Planned Unit Development -Low Density
Residential and Open Space) District.
WHEREAS, at its duly noticed public hearing of Apri126, 2006, the Planning Commission considered
all public testimony, relevant exhibits, and recommendations of the City staff concerning
this application; and
WHEREAS, the environmental review for the proposed project was undertaken with the Final
Environmental Impact Report (EIR) for the Vineyard Avenue Corridor Specific Plan,
approved by the City Council on March 1999 in conformance with the standards of the
California Environmental Quality Act (CEQA); and there are no substantial changes to
the project or to the circumstances under which the project is being undertaken that
involve new significant environmental effects or that substantially increase the severity of
previously identified effects; furthermore, there is no new information of substantial
importance, which was unknown at the time that the Final EIR was approved by the City
Council regarding the project or its effects, mitigation measures, or alternatives, and any
previously identified effects or impacts are mitigated to a level of insignificance, with the
mitigation measures incorporated into the project's design or imposed on the project
pursuant to the conditions of approval; and
WHEREAS, the Planning Commission made the following findings for the PUD development plan:
The plan is in the best interests of the public health, safety, and general welfare.
The proposed project, as designed and conditioned, meets all applicable City standards
concerning public health, safety, and welfare, e.g., vehicle access, geologic hazards (new
development not within a special studies zone), and flood hazards. Full public streets and
water, storm, and sanitary sewer lines are present to serve the proposed lots on this site.
Therefore, this finding can be made.
