MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> Pleasanton, California <br /> April 6, ].970 <br /> <br />CALL TO ORDER - PLEDGE TO FLAG <br /> Mayor Bernard Getton called the Adjourned Regular Meeting of the City Council <br /> to order at 8:00 P.M., and then led the pledge of allegiance to the flag. <br /> <br />ROLL CALL <br /> City Clerk Helen McCarty called the roll which is recorded as follows: <br />Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton were present. <br />Mr. Fales, City Manager, Mr. Edgar, Assistant City Manager, Mr. Hirst, City <br />Attorney, Mr. Campbell, Director of Public Works, and Mr. Aiello, Assistant <br />Director of Planning, were present. Mr. Castro, Director of Planning, was absent. <br /> <br />AGENDA A,M~.NDMENT__S <br /> Councilman Spiliotopoulos requested that items a and b be removed from the <br />Consent Calendar in order that they may be discussed again. <br /> <br />CONSENT CALENDAR <br /> It ~,:as moved by Councilman Spiliotopoulos and seconded by Councilman Reid that <br /> the following items listed on the Consent Calendar be approved: <br /> <br />c. Adoption of Resolution No. 70-61, accepting the public improvements in Tract <br /> No. 2987, Foothill Farms, Unit No. 2. <br /> <br />d. Adoption of Resolution No. 70-62, authorizing Progress Payment No. 5, in the <br /> amount of $19,714.50, be paid to A. & J. Shooter, Incorporated, for work com- <br /> pleted on the Amador Valley Community Park. <br /> <br />e. Adoption of Resolution No. 70-63, authorizing Progress Payment No. 5, in the <br /> amount of $49,234.68, be paid to Armand and Smith Construction Company, for <br /> work completed in the Amador Valley Community Park. <br /> <br />f. Adoption of Resolution No. 70-64, authorizing the approval of an Agreement <br /> with the Alameda County Fair Board of Directors that the fire engine which <br /> has been placed at the Fairgrounds, be retired from active service. <br /> <br />g. Adoption of Resolution No. 70-65, authorizing the City Clerk to complete the <br /> canvass of election returns prior to April 21, 1970. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br /> <br />Waive reading; Ord. No. 594,..~e: Busine,~ License Ordinance <br />Adoption of Ordinance No. 594 <br /> Councilman Spiliotopoulos initiated discussion on the above items which were <br />listed as a and b on the Consent Calendar. He strongly objected that the range of <br />fees was not specific enough and needed to be more realistic. He cited the in- <br />stance that Kaiser Sand and Gravel should pay more than $250.00, which is the <br />highest fee, because of the damage to the City's streets and roads that their <br />trucks cause. Councilman Spiliotopoulos also stated that he felt the entire range <br />of fees should be based on a nattower range of gross receipts. <br /> Councilman Beratlis stated that he felt the companies with higher gross re- <br />ceipts should accept more of the burden. <br /> Councilman Spiliotopoulos requested that this matter be delayed until the staff <br />could determine a more realistic range. <br />Mr. Fales objected to this request by stating that this is a revenue producing <br />ordinance and must be approved now in order for it to become effective July 1, 1970. <br /> Discussion ensued regarding the matter of Kaiser's particular operation and Mr. <br />Hirst stated he would provide a legal opinion on whether or not Kaiser Sand and <br />Gravel could be charged a separate rate. <br /> <br /> <br />
