MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> June 3, 1976 <br /> <br /> CALL TO ORDER - PLEDGE TO THE FLAG <br /> Mayor Robert Philcox called the Adjourned Regular Meeting of the City Council <br /> to order at 8:15 P.M~, and then led the Pledge of Allegiance to the flag. <br /> <br />ROLL CALL <br /> Deputy City Clerk Doris George called the roll which is recorded as follows: <br />Councilmembers Brandes, Herlihy, LoCisire, Mercer, and Mayor Philcox were present. <br />Mr. Edgar, City Manager, Mr. Scheidig, City Attorney, Mr. Harris, Director of <br />Planning, and Mro Sooby, Director of Engineering Services, were present. <br /> <br />PUBLIC HEARINGS <br />Appeal. of the Decision of the City Manager to file a Negative Declaration for <br />UP-76-11~ an application for a Conditional Use Permit to construct and operate <br />a Service Station on the Northwest Corner of Hopyard Road and Johnson Industrial <br />Drive (Continued Open from 5-24-76) <br /> Councilmember Mercer abstained from participating on this item because of a <br />moral conflict of interesto <br /> <br /> Mr. Edgar stated that 1,153 post cards had been received at City Hall this <br />week, addressed to the City Council, in support of a self-service gasoline <br />station at Hopyard Road and Johnson Industrial Drive, and presented the list <br />to the City Council. He also presented a report of the Director of Engineering <br />Services dated June 2, 1976, regarding traffic impact of the proposed service <br />station. <br /> <br /> Mr. Harris presented his staff report dated May 18, 1976, regarding this <br />matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Mr. Joe Schwab, Attorney, representing the appellant, stated he was concerned <br />with the speed at which this application was being processed. He listed the <br />reasons for which he felt an Environmental Impact Report was essential as being <br />that aesthetically there is a strong possibility that it will cause harm to the <br />community and the traffic circulation impact. He also stated that the economic <br />impact should be considered in deciding whether or not to require an Environ- <br />mental Impact Report° Mro Schwab quoted from a Planning Report dated 1969 which <br />reconm~ended that a service station application be denied at this location because <br />of an o~l-saturaticn of service stations in this area. He also stated that <br />Coun<'~ ~xp~ssed concern about an over-abundance of service stations at the time <br />the Exxon Station on Hopyard Road and Valley Avenue was permitted to be constructed. <br />Mr~ Schwab coneladed by stating that his client felt that an Environmental Impact <br />Re~o'rt was necessary in order to get the full picture, and requested approval of <br />the appeal of the City Manager's Negative Declaration decision. <br /> <br /> MT~ ~,,~illiam Hirst, At[orney, representing Vernon Dickman, the owner of the <br />property in question, stated he had reviewed the Notice of Intent and the staff <br />reports and was in agreement with them, and that he felt there would be no ad- <br />verse aesthetic ilapact on the community because of this development, nor would <br />it ~.reate any significant traffic impact as there would be no ingress or egress <br />onto Hop~ard Road directly from this proposed service station. He stated the <br />application should be heard on its merits and respectfully requested denial of <br />the appeal. <br /> <br /> Mrs~ Anna Martinsen, 4038 Payne Road, read a letter from Mro Don Savory, <br />6738 Rancho Court, which expressed concern about any development on this corner <br />because of traffic and its possible long range affect upon the widening of Hop- <br />yard Road~ He stated he felt that the proposed development would have signifi- <br />cant adverse affect on the City o~ Pleasanton and the citizens of Pleasanton, <br />and he requested that an Environmental Impact Report be made. <br /> <br /> <br />
