MINUTES <br /> OF <br /> THE <br /> MEETING <br /> OF <br /> THE CITY COUNCIL <br /> <br /> May 6, 1997 <br /> <br />6:00 p.m. CLOSED SESSION - Conference with legal counsel to discuss potential litigation that <br />Kaufman & Broad may file against the City of Pleasanton concerning the City Council' s decision <br />on April 15, 1997 not to certify the Final EIR for the Staples Ranch project. <br /> <br />1. CALL TO ORDER <br /> Mayor Ben Tarver called the Regular Meeting of the City Council to order at 7:12 p.m. <br /> <br /> Ms. Dennis led the assembly in the pledge of allegiance. She welcomed all new <br />commissioners and committee members and thanked the outgoing members. <br /> <br />2. ROLL CALL <br /> <br /> City Clerk Peggy L. Ezidro called the roll, which is recorded as follows: <br />Councilmembers present were Kay Ayala, Becky Dennis, Sharrell Michelotti, Thomas P. Pico, <br />Jr. and Mayor Ben Tarver. Staff members present were: Deborah Acosta, City Manager; <br />Michael H. Roush, City Attorney; Brian W. Swift, Director of Planning and Community <br />Development; Randall A. Lum, Director of Public Works; Bill van Gelder, Traffic Engineer; <br />and Steven Bocian, Assistant City Manager. <br /> <br /> Mr. Roush reported there had been a request for the City Council to consider a tolling <br />agreement stemming from Council's decision on April 15 not to certify a final EIR for the <br />Staples Ranch project. The applicant (Kaufman & Broad) would like additional time to present <br />information to the Council. Council considered this request in closed session and on a vote 4-1 <br />(Tarver, no) approved a tolling agreement that would extend the time to file suit 45 days from <br />today. <br /> <br />3. AGENDA AMENDMENTS <br /> <br /> Item 7a, Consideration of additional information for the Supplemental EIR for the <br />Stoneridge Drive Specific Plan amendment (SPA-95-01).
