MINUTES OF THE MEETING OF THE CITY COUNCIL May 6, 1997 6:00 p.m. CLOSED SESSION - Conference with legal counsel to discuss potential litigation that Kaufman & Broad may file against the City of Pleasanton concerning the City Council' s decision on April 15, 1997 not to certify the Final EIR for the Staples Ranch project. 1. CALL TO ORDER Mayor Ben Tarver called the Regular Meeting of the City Council to order at 7:12 p.m. Ms. Dennis led the assembly in the pledge of allegiance. She welcomed all new commissioners and committee members and thanked the outgoing members. 2. ROLL CALL City Clerk Peggy L. Ezidro called the roll, which is recorded as follows: Councilmembers present were Kay Ayala, Becky Dennis, Sharrell Michelotti, Thomas P. Pico, Jr. and Mayor Ben Tarver. Staff members present were: Deborah Acosta, City Manager; Michael H. Roush, City Attorney; Brian W. Swift, Director of Planning and Community Development; Randall A. Lum, Director of Public Works; Bill van Gelder, Traffic Engineer; and Steven Bocian, Assistant City Manager. Mr. Roush reported there had been a request for the City Council to consider a tolling agreement stemming from Council's decision on April 15 not to certify a final EIR for the Staples Ranch project. The applicant (Kaufman & Broad) would like additional time to present information to the Council. Council considered this request in closed session and on a vote 4-1 (Tarver, no) approved a tolling agreement that would extend the time to file suit 45 days from today. 3. AGENDA AMENDMENTS Item 7a, Consideration of additional information for the Supplemental EIR for the Stoneridge Drive Specific Plan amendment (SPA-95-01).
