PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2749 <br />A RESOLUTION OF THE PLANNING COMMISSION APPROVING <br />CASE UP-85-54, AN APPLICATION OF LEONARD ZAVALA <br />WHEREAS, Leonard Zavala has applied for a conditional use permit <br />to operate a take-out food establishment to be located <br />at 6280 West Las Positas Boulevard; and <br />WHEREAS, zoning for the property is CN (Neighborhood Commercial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of January 22, 1986 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found a) that the proposed <br />location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purposes <br />of the district in which the site is located. <br />The site on which the proposed use would be located is <br />surrounded on the north and east by similar type uses. <br />In addition, at the time of the approval for the <br />building now under construction uses of the type were <br />planned for by providing adequate access and parking. <br />WHEREAS, the Planning Commission found b) that the proposed <br />location of the conditional use and the conditions under <br />which it would be operated or maintained will not be <br />detrimental to the public heath, safety or welfare, or <br />materially injurious to the properties or improvements <br />in the vicinity. <br />The location of the use is within an approved <br />neighborhood commercial center and will not be <br />detrimental to the public health, safety or welfare of <br />adjacent properties. All activities will take place <br />within the confines of the tenant space. <br />WHEREAS, the Planning Commission found c) that the proposed <br />conditional use will comply with each of the applicable <br />provisions of this chapter. <br />The proposed use is in compliance with Uniform Building <br />Code, Fire Code and all other applicable provisions of <br />this chapter and other applicable regulations. <br />
