ATTACHMENT 1 <br />RESOLUTION NO. 07- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />DENYING The APPEAL OF CASE PAP-105, THEREBY UPHOLDING THE <br />PLANNING COMMISSION'S APPROVAL OF THE APPLICATION OF TRINITY <br />LUTHERAN CHURCH FOR A CONDITIONAL USE PERMIT AND DESIGN REVIEW, <br />AS FILED UNDER CASE PCUP-155/PDR-513 <br />WHEREAS, Trinity Lutheran Church has applied for a conditional use permit and <br />design review for the expansion of the existing Trinity Lutheran Church, located at <br />1225 Hopyard Road, consisting of the replacement of the existing temporary modular <br />buildings with an approximately 8,100-square-foot one-story education building to the east <br />of the existing Church facility; the construction of an approximately 3,108-square-foot <br />multipurpose room addition to be attached to the south of the existing Church facility, <br />fronting Hopyard Road; the expansion of the existing parking lot; and on-site landscaping <br />removal and replanting; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) <br />District; and <br />WHEREAS, at its meeting of January 24, 2007, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City <br />staff concerning this application, approved the application for conditional use permit and <br />design review; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Heather <br />Brillhart submitted an appeal (Case PAP-105) to the decision of the Planning Commission; <br />and <br />WHEREAS, at its meeting of March 20, 2007, the City Council received a report <br />from the Acting Director of Planning and Community Development, together with a copy of <br />the staff report to the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on March 20, 2007, at which <br />time the appellant and any other member of the public were offered an opportunity to <br />present evidence regrading this appeal; and <br />WHEREAS, actions of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act (CEQA) Guidelines, <br />Section 15302, Replacement and Reconstruction, Class 2, Subsection (a); and <br />WHEREAS, after receiving public testimony and review and the materials <br />presented, the City Council determined that the proposed conditional use and design <br />are appropriate for the site, will not detrimentally affect the surrounding properties, and <br />consistent with the zoning regulations for the zoning district of the property <br />
