CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COI/NTY, CALIFORNIA <br /> RESOLUTION NO. 94-04 <br /> <br /> RESOLUTION APPROVING CASE PUD-8S-08-SD, THE <br /> APPLICATION OF PRUDENTIAL INSURANCE COMPANY <br /> OF NORTH AMFRICA <br /> <br />WHEREAS, Prudential Insurance Company has applied for development plan (site plan, <br /> building design, landscaping, and signage) approval to construct an approximately <br /> 126,390 square foot retail store on a 15.06 acre portion of a 32.3 acre site located <br /> at the northeast coruer of Hacienda Drive and Owens Drive in the Hacienda <br /> Business Park; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - Mixed <br /> Commercial/Office and Industrial Planned Development District (MCOIPD); and <br /> <br />WHEREAS, based on the Initial Study, a negative declaration was adopted by Council on <br /> lanuary 4, 1994; and <br /> <br />WHEREAS, a public hearing was held on January 4, 1994, and testimony taken concerning the <br /> proposed project including its design, cumulative impact, consistency with the <br /> General Plan; and <br /> <br />WHEREAS, there is a pending lawsuit and there may be future lawsuits which may seek to <br /> invalidate or othenvise affect this Wal-Mart approval ("Wal-Mart Approval") <br /> and/or the approvals relating to Hacienda Business Park (collectively, "Park <br /> Approvals"); and <br /> <br />WHEREAS, it is therefore possible that a court may issue an order, writ, or enter a judgment <br /> (collectively, "Judgment") that affects all or any potion of the Wal-Mart <br /> Approval; and <br /> <br /> WHEREAS, City has consistently found and determined, in its legislative wisdom and <br /> administrative discretion, that the Park Approvals and this Wal-Mart Approval are <br /> in the best interests of the community as a whole; and <br /> <br /> WHEREAS, the City Council finds that the project is consistent with the City's General Plan <br /> and with PUD-85-5. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOL~ <br /> AS FOLLOWS: <br /> <br /> <br />
