CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COI/NTY, CALIFORNIA RESOLUTION NO. 94-04 RESOLUTION APPROVING CASE PUD-8S-08-SD, THE APPLICATION OF PRUDENTIAL INSURANCE COMPANY OF NORTH AMFRICA WHEREAS, Prudential Insurance Company has applied for development plan (site plan, building design, landscaping, and signage) approval to construct an approximately 126,390 square foot retail store on a 15.06 acre portion of a 32.3 acre site located at the northeast coruer of Hacienda Drive and Owens Drive in the Hacienda Business Park; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - Mixed Commercial/Office and Industrial Planned Development District (MCOIPD); and WHEREAS, based on the Initial Study, a negative declaration was adopted by Council on lanuary 4, 1994; and WHEREAS, a public hearing was held on January 4, 1994, and testimony taken concerning the proposed project including its design, cumulative impact, consistency with the General Plan; and WHEREAS, there is a pending lawsuit and there may be future lawsuits which may seek to invalidate or othenvise affect this Wal-Mart approval ("Wal-Mart Approval") and/or the approvals relating to Hacienda Business Park (collectively, "Park Approvals"); and WHEREAS, it is therefore possible that a court may issue an order, writ, or enter a judgment (collectively, "Judgment") that affects all or any potion of the Wal-Mart Approval; and WHEREAS, City has consistently found and determined, in its legislative wisdom and administrative discretion, that the Park Approvals and this Wal-Mart Approval are in the best interests of the community as a whole; and WHEREAS, the City Council finds that the project is consistent with the City's General Plan and with PUD-85-5. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOL~ AS FOLLOWS:
