<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 91-16 <br /> <br />RESOLUTION RECOMMENDING CANCELLATION OF THE WILLIAMSON ACT <br />FOR THE BONDE RANCH <br /> <br />WHEREAS, a request and petition for cancellation of AgricUltural <br />Preserve Contract on the Bonde Ranch property was filed <br />with the City of Pleasanton on behalf of the owner of the <br />property, which is located on the northerly and southerly <br />sides of Bernal Avenue, approximately 2,250 feet <br />southeasterly of Sunol Boulevard; and <br /> <br />WHEREAS, the property involved is all within the city limits of <br />the City of Pleasanton; and <br /> <br />WHEREAS, a public hearing was called and duly noticed for this <br />date; and <br /> <br />WHEREAS, the Planning commission has reviewed and considered the <br />Environmental Impact Report for the Bonde Ranch Projects <br />(PUD-90-18l which analyzed the environmental effects of <br />the proposed Bonde Ranch PUD residential project and the <br />loss of agricultural lands, and therefore, no additional <br />environmental review is required; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />Cancellation of the williamson Act for the Bonde property <br />is consistent with the purposes of the williamson Act. <br /> <br />A. The cancellation is for land on which a Notice of <br />Non-Renewal has been served pursuant to section <br />51245. <br /> <br />A Notice of Non-Renewal of the contract was filed <br />with Alameda County in February, 1988 and became <br />effective on January 1, 1989. Therefore, the <br />Notice of Non-Renewal has been served pursuant to <br />section 51245 of the Government Code. (All <br />references hereafter to code sections are to the <br />Government Code.) <br /> <br />B. The cancellation is not likely to result in the <br />removal of adjacent lands from agricultural use. <br /> <br />Existing single-family residential neighborhoods <br />surround the Bonde property on three sides: to the <br />west and southwest are the recent Diamond <br />Collection and Ventana Hills developments; to the <br />east is the now-developing Kottinger Ranch <br />
