PLANNING COMMISSION CITY 0' PL!lSANTON

ALAMEDA COUNTY, CALJ:FORNJ:A

RESOLUTION NO. PC-93-17

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS rILED UNDER
CASE UP-93-8 FOR PAUL FAGLIANO

WHEREAS, Paul Fagliano has applied for a conditional use permit to
operate a horse stable and boarding facility on an
existing 5.5 acre rural parcel located at 1364 Vineyard
Avenue; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Agricultural District; and

WHEREAS, at their duly noticed public hearing of April 14, 1993,
the Planning commission considered all public testimony,
relevant exhibits and recommendations of the City staff
concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. That the proposed location of the conditional use
is in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

One of the primary objectives of the City'S Zoning
Ordinance is to "...foster a harmonious,
convenient, workable relationship among land uses."
Staff believes that the proposed horse stable and
boarding facility is an appropriate use for the
subject site and one which should not have adverse
impacts on adjacent properties if conditioned as
recommended. Staff has included a condition of
approval which would allow the city to review the
use permit if the operation of the use results in
conflicts pertaining to parking, noise, traffic, or
other impacts. If necessary, the planning
commission could modify or add conditions of
approval to mitigate any impacts, or could revoke
the conditional use permit if deemed appropriate.
The proposed use is consistent with the general
purposes of the "Agricultural" zoning district.

B. That the proposed location of the conditional use
and the conditions under which it would be operated
or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.
