PC-93-17 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS rILED UNDER <br />CASE UP-93-8 FOR PAUL FAGLIANO <br /> <br />WHEREAS, Paul Fagliano has applied for a conditional use permit to <br />operate a horse stable and boarding facility on an <br />existing 5.5 acre rural parcel located at 1364 Vineyard <br />Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Agricultural District; and <br /> <br />WHEREAS, at their duly noticed public hearing of April 14, 1993, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the primary objectives of the City'S Zoning <br />Ordinance is to "...foster a harmonious, <br />convenient, workable relationship among land uses." <br />Staff believes that the proposed horse stable and <br />boarding facility is an appropriate use for the <br />subject site and one which should not have adverse <br />impacts on adjacent properties if conditioned as <br />recommended. Staff has included a condition of <br />approval which would allow the city to review the <br />use permit if the operation of the use results in <br />conflicts pertaining to parking, noise, traffic, or <br />other impacts. If necessary, the planning <br />commission could modify or add conditions of <br />approval to mitigate any impacts, or could revoke <br />the conditional use permit if deemed appropriate. <br />The proposed use is consistent with the general <br />purposes of the "Agricultural" zoning district. <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
