PLANNING COMMXSSION CITY OF PLEASANTON

ALAMEDA COWiTY, CAL:IFOlUl:IA

RESOLUTION NO. PC-93-10

RESOLUTJ:ON APPROVJ:NG A NON-EXEMPT HOME OCCUPATXON PERMXT AS
FXLED UNDER CASE UP-92-68 FOR KXMBERLEY MULLEN

WHEREAS, Kimberley Mullen has applied for a non-exempt home
occupation permit to operate an in-home therapeutic
massage service in one room of a residence located at
8003 #4 Arroyo Drive; and

WHEREAS, zoning for the property is RM-25 District;

WHEREAS, at their duly noticed public hearing of February 24,
1993, the Planning commission considered all public
testimony, relevant exhibits and recommendations of the
City staff concerning this application; and

WHEREAS, the Planning commission made the following findings:

A. That the proposed location of the conditional use
is in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

Chapters 18.32 and 18.36 permit home occupations to
be conducted in residences in the R-l and RM zoning
districts, in accordance with chapter 18.104 (Home
Occupations). Some of the objectives of the R-l
and RM districts are to protect residential
properties from the hazards, noise and congestion
created by commercial and industrial traffic, and
to protect properties from noise, illumination,
unsightliness, odors, dust, dirt and other
objectionable influences and hazards.

The objective of Chapter 18.104 is to permit
certain home occupations which will not affect
adversely the residential character of a
neighborhood, yet to permit the conduct of certain
activities which could occur within a residence and
be unnoticeable from the exterior, such as
therapeutic massage. The required conditions for
non-exempt home occupations meet the objectives of
the R-l and RM zoning districts by not permitting
manUfacturing or deliveries to the home, or the
creation of pedestrian or vehicular traffic in
excess of that usually generated by residential
uses.

.. ., .
