PC-93-10 <br /> <br />RESOLUTJ:ON APPROVJ:NG A NON-EXEMPT HOME OCCUPATXON PERMXT AS <br />FXLED UNDER CASE UP-92-68 FOR KXMBERLEY MULLEN <br /> <br />WHEREAS, Kimberley Mullen has applied for a non-exempt home <br />occupation permit to operate an in-home therapeutic <br />massage service in one room of a residence located at <br />8003 #4 Arroyo Drive; and <br /> <br />WHEREAS, zoning for the property is RM-25 District; <br /> <br />WHEREAS, at their duly noticed public hearing of February 24, <br />1993, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to <br />be conducted in residences in the R-l and RM zoning <br />districts, in accordance with chapter 18.104 (Home <br />Occupations). Some of the objectives of the R-l <br />and RM districts are to protect residential <br />properties from the hazards, noise and congestion <br />created by commercial and industrial traffic, and <br />to protect properties from noise, illumination, <br />unsightliness, odors, dust, dirt and other <br />objectionable influences and hazards. <br /> <br />The objective of Chapter 18.104 is to permit <br />certain home occupations which will not affect <br />adversely the residential character of a <br />neighborhood, yet to permit the conduct of certain <br />activities which could occur within a residence and <br />be unnoticeable from the exterior, such as <br />therapeutic massage. The required conditions for <br />non-exempt home occupations meet the objectives of <br />the R-l and RM zoning districts by not permitting <br />manUfacturing or deliveries to the home, or the <br />creation of pedestrian or vehicular traffic in <br />excess of that usually generated by residential <br />uses. <br /> <br />.. ., . <br />
