<br />Rssolution No. PC-93-10 <br />Page 2 <br /> <br />The location of the home in which the therapeutic <br />massage is to be conducted is in an RM-25 (multi- <br />family residential) zoning district. Although <br />therapeutic massage perhaps has not traditionally <br />been practiced out of the home in this city, it is <br />not uncommon to find such services provided in <br />private homes in other jurisdictions. The small <br />scale of the proposed business would be such that <br />additional vehicular traffic, parking demand, or <br />noise in the neighborhood would be negligible. <br /> <br />Additionally, as with all massage therapy <br />practitioners, the applicant is required to obtain <br />a permit to perform massage therapy from the city's <br />Police Department before the business can be <br />established. Among other things, this Police <br />Department permit ensures that the facilities are <br />appropriate for operating a therapeutic massage <br />establishment, in accordance with city ordinances <br />and building regulations. These regulations are in <br />conformance with the intent and objective of the R- <br />1 and RM zoning districts. <br /> <br />Therefore, the massage therapy would be conducted <br />in accordance with Chapter 18.104, and so would <br />meet the objectives of the zoning ordinance. <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The use would be located in one unit of a four-unit <br />condominium complex. The area is improved <br />completely with streets and sidewalks and parking <br />is permissible along all streets near the unit. <br />The unit is located toward the front of the <br />complex, near the main entrance. This location <br />limits non-resident traffic to the main entrance <br />and the frontage road, with no need for non- <br />residents to travel elsewhere through the complex. <br /> <br />The in-home therapeutic massage would not be <br />detrimental to the public, health, safety or <br />welfare. Although some additional vehicular or <br />pedestrian traffic may be created by the <br />applicant's clients, the hours of operation are <br />such that it would not interfere with the quiet <br />morning and evening hours normally associated with <br />residential districts. <br /> <br />- <br />
