.

PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-92-3

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER
CASE UP-91-85 FOR BRIAN AND WENDY LYNCH

WHEREAS, Brian and wendy Lynch has applied for a conditional use
permit to allow a secondary unit to be installed within
an existing single-family residence located at 611
Windmill Lane; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Medium Density Residential District; and

WHEREAS, at their duly noticed public hearing of January 8, 1992,
the Planning commission considered all public testimony,
relevant exhibits and recommendations of the City staff
concerning this application; and

WHEREAS, the Planning commission made the following findings:

A. The proposed location of the conditional use is in
accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The proposed secondary unit is located in a PUD-MDR
district which conforms to the regulations
specified in the code for an R-1-10, 000 zoning
district. The request to establish a secondary
unit in a single-family residential district
conforms to the objectives of the Zoning Ordinance
and the purpose of the one-family residential
district. These districts are intended to preserve
lower population densities than mUlti-family
residential districts, and special consideration
may be given to issues which may effect privacy,
traffic volumes and design. The proposed unit does
not alter the exterior of the existing house, is
small in size, and integrates well within the
existing home. This helps maintain the single-
family character of the neighborhood.

B. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, and welfare, or materially
injurious to the properties in the vicinity.

The following issues must be considered within the
scope of public health, safety and welfare:
