,

PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-95-16

RESOLUTION APPROVING THE APPLICATION OF DONALD B. SHARVER FOR
A CONDITIONAL USE PERMIT TO ALLOW USED CAR SALES, AS FILED
UNDER CASE UP-9S-06

WHEREAS, Donald B. Sharver has applied for a conditional use
permit to allow used car sales (no servicing or outdoor
display) within an approximately 1,000 square foot space
located at 3715 Old Santa Rita Road; and

WHEREAS, zoning for the property is C-S (Service commercial)
District; and

WHEREAS, at their duly noticed public hearing of March 8, 1995,
the planning commission considered all public testimony,
relevant exhibits and recommendations of the city staff
concerning this application; and

WHEREAS, the Planning commission made the following findings:

A. The proposed location of the conditional use is in
accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The subject property is zoned c-s (commercial
service) district which is intended to provide
sites for businesses typically not found in
shopping centers having little or no pedestrian
traffic. Existing uses on the project site include
a meeting hall and counseling service for
recovering alcoholics, building contractors and
sub-contractors, a sign manufacturer, an automobile
upholsterer, and trade in piano rentals/servicing,
floor finishes, catering, building and auto glass.
The proposed used-car business is similar in that
it can be conducted entirely from within the suite,
and it will attract little walk-in traffic,
generate a relative small number of vehicle trips,
and require a relative low number of employees.

B. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

.
