<br />Resolution No. PC-95-16 <br />Page 2 <br /> <br />Nearby residential uses include the Hacienda <br />Gardens apartments located on the intersection of <br />Old Santa Rita Road and Santa Rita Road, and <br />miscellaneous single-family homes interspersed <br />along the east side of the street are separated <br />from the overall project site by distance and <br />existing commercial uses. They would not be <br />affected by the proposed used car business. <br /> <br />For the mixed use nature of this particular site, <br />staff has applied a parking ratio of one parking <br />space per 350 sq. ft. Based on this standard, <br />three parking spaces would be required for the <br />1,000 sq. ft. used car business. There are 67 <br />full-size parking spaces on the project site and, <br />ample on-street parking on Old Santa Rita Road <br />directly accessible to the proposed business suite. <br />Given the small number of employees -- two -- and <br />number of customers -- two per day -- anticipated <br />by the applicant, combined with the part-time <br />nature of the proposed business, staff believes <br />there would be adequate parking for employees and <br />customers. <br /> <br />The proposed business would be required to comply <br />with the Uniform Building Code and the Pleasanton <br />Fire Code, and would be required to secure the <br />appropriate city permits prior to commencement. If <br />necessary, the existing suite would be properly <br />retrofitted to accommodate business needs. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />By complying with the recommended conditions of <br />approval, the application would meet the criteria <br />for receiving a conditional use permit and would, <br />therefore, comply with the intent of the zoning <br />ordinance. As with any use permit, the permit for <br />the used car business can be suspended or revoked <br />if the conditions are not met. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />project is compatible with the existing businesses <br />located on the overall project site and the surrounding <br />area. <br /> <br />. <br />
