<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-08 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF DERMALOGICA, INC. FOR <br />CONDITIONAL USE PERMIT APPROVAL, AS FILED UNDER CASE PCUP-I 05 <br /> <br />WHEREAS, Dermalogica, Inc. has applied for a minor modification to the approved PUD <br />development plan for Pleasanton Park (PUD-80-14) and for conditional use <br />permit approval to operate a trade/business school in an existing building located <br />at 6678 Owens Drive; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development -Commercial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 28, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The objectives stated in the zoning ordinance include fostering harmonious, <br />convenient, workable relationship among land uses, protecting land uses from <br />inharmonious influences and harmful intrusions, and insuring that public and <br />private lands are used for the purposes which are most appropriate and beneficial <br />to the City as a whole. <br /> <br />The proposed use is in an office setting similar in nature to other office uses in the <br />business complex. The training would be held from 10:00 a.m. to 5:00 p.m. To <br />ensure a harmonious and workable relationship with other tenants in the <br />proximity, conditions of approval require that the "open student day" event be <br />held either after the regular business hours or on weekends, if necessary, to keep <br />impact on parking at the minimal. As conditioned, the proposed use is in <br />accordance with the object of the zoning ordinance and the purpose of the district <br />in which the site is located, and, therefore, this finding can be made. <br /> <br />I I <br />
