The proposed location ofthe conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Dermalogica has been in business at the subject location since March 2001, and <br />no complaints were received concerning its operation. The number of parking <br />spaces available to Dermalogica meets the City parking requirement for a school. <br />The parking survey conducted on various days show that parking provided on the <br />subject site is adequate to support the proposed business school. To ensure that <br />adequate parking would continue to be provided to the building tenants when the <br />subject building is fully leased, as conditioned, monthly "open student day" event <br />are to be held outside the regular business hours of 8:00 a.m. to 5:00 p.m. or on <br />weekends if complaints concerning parking are reported to the Planning <br />Department. With the proposed conditions of approval, therefore, this finding can <br />be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />As conditioned, the proposed use will comply with all provisions and <br />requirements of the City's zoning ordinance and the approved PUD development <br />plan if the proposed minor modification is approved by the City Council. As with <br />any conditional use permit, the use permit may be suspended or revoked if the <br />conditions are not met. Therefore, the proposed use will comply with the <br />provisions of the Zoning Ordinance, and this finding can be made. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-I05, the application of Dermalogica, Inc. for a conditional <br />use permit approval to operate a tradelbusiness school in an existing building <br />located at 6678 Owens Drive, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
