<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-22 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />RAYMUND VILLANUEV AIIN-N-OUT BURGER FOR CONDITIONAL USE <br />PERMIT AND DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE <br />PUD-96-05/UP-96-0S <br /> <br />WHEREAS, Raymund Villanueva/IN-N-OUT Burger has applied for conditional use permit <br />and development plan approval to construct a new, approximately 2,919 square <br />foot, fast-food restaurant with drive-through, and for development plan approval <br />for a 6,300 square foot retail building pad on the former Budget Rent-a-Car and <br />Guaranty R.V. Center site at 4011 Pimlico Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of April 1 0, 1996, the Planning Commission, <br />after considering all public testimony, relevant exhibits, and recommendations of <br />the City staff concerning this application, recommended approval of the proposed <br />negative declaration for Case PUD-96-0S/UP-96-0S; and <br /> <br />WHEREAS, the Planning Commission made the following conditional use permit findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is located. <br /> <br />The subject use would be located on a site with a commercial zoning designation <br />that has incorporated the uses and standards ofthe City's C-C (Central <br />Commercial) district. The C-C district permits a variety of retail establishments, <br />including restaurants, and drive-through restaurants are conditionally permitted <br />uses in this district. An objective of the commercial zoning districts is to provide <br />appropriately located areas for retail stores, service establishments, etc., which <br />offer commodities and services required by residents and workers. In addition, <br />such uses are encouraged to concentrate for the convenience of the public and for <br />mutual benefit. The location of this drive-through restaurant adjacent to other <br />restaurants and retail establishments meets these objectives. <br />
