The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br /> <br />The project's design, location, activities, and conditions of approval will result in <br />it being operated in a non-nuisance, safe manner. Other drive-through restaurants <br />within the City operate satisfactorily under similar conditions. A standard use <br />permit condition of approval has been added which allows the Planning <br />Commission to reconsider the use permit approval if necessary to address any <br />unforeseen nuisances. <br /> <br />A traffic study has concluded that traffic from the proposed project could be <br />accommodated by existing streets and intersections with no significant traffic <br />impacts nor increased levels-of-service. The two existing driveways would be <br />removed from the site and a single 40 ft. wide driveway offPimlico Drive would <br />be installed. The proposed driveway would align with an existing 36 ft. wide <br />driveway at the Trader Joe's Plaza shopping center property on the opposite side <br />of Pimlico Drive. Consolidation and realignment of the existing driveways would <br />improve traffic circulation and safety on Pimlico Drive. The entrance to the <br />drive-through lane would be clearly marked and would not interfere with on- or <br />off-site traffic patterns. There is adequate stacking within the drive-through lane <br />which will help preclude conflicts with adjacent parking spaces and on-site traffic <br />movements. The proposed drive-through has incorporated two windows (a pay <br />window and a pick-up window) and two reader boards. The proposed <br />drive-through will be extremely efficient and would not create additional <br />emissions over that of a sit-down restaurant. Also, the proposed use will have <br />adequate parking to meet project demand. <br /> <br />C. The proposed conditional use will comply with each of the applicable provisions <br />of this chapter. <br /> <br />As proposed and conditioned, the use complies with all applicable regulations of <br />the zoning district in which it is located. <br />
