<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-09 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF ARBY'S RESTAURANT FOR <br />DESIGN REVIEW AND CONDITIONAL USE PERMIT APPROVALS, AS FILED <br />UNDER CASE PUD-81-30-61D AND UP-96-02 <br /> <br />WHEREAS, Arby's Restaurant has applied for design review and conditional use permit <br />approvals to allow the construction of a one-story, 3,070 square foot Arby's <br />drive-through and sit-down fast-food restaurant on a portion of an existing vacant <br />2.31 acre site (Lot 5C) in the Hacienda Business Park, 5900 Owens Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - I/C-O <br />(Industrial/Commercial - Office) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of February 14, 1996, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared in conjunction with the PUD <br />approval for the entire Hacienda Business Park and the proposed project is within <br />the scope of the EIR; therefore, no environmental document was prepared for this <br />project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives ofthe zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The subject use would be located on a site with a retail designation that has <br />incorporated the uses and standards of the City's C-C (Central Commercial) <br />district. The C-C district permits a variety of retail establishments, including <br />restaurants, and drive-through restaurants are conditionally permitted uses in this <br />district. An objective of the commercial zoning districts is to provide <br />appropriately located areas for retail stores, service establishments, etc., which <br />offer commodities and services required by residents and workers. In addition, <br />such uses are encouraged to concentrate for the convenience of the public and for <br />mutual benefit. The location of this drive-through restaurant adjacent to other <br />restaurants, retail establishments, and the offices of the North Pleasanton business <br />parks meets these objectives. <br />
