The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The project's design, location, and conditions of approval will result in it being <br />operated in a non-nuisance, safe manner. Other drive-through restaurants within <br />the City operate satisfactorily under similar conditions. Staff has added a standard <br />use permit condition of approval which allows the Planning Commission to <br />reconsider the use permit approval to address any unforeseen nuisances. <br /> <br />The entrance to the drive-through lane would be clearly marked and would not <br />interfere with on- or off-site traffic patterns. There is adequate stacking within <br />the drive-through lane which will help preclude conflicts with adjacent parking <br />spaces and on-site traffic movements. <br /> <br />Any drive-through establishment is a potential source of air emissions, <br />particularly carbon monoxide, due to cars idling while customers are waiting to <br />order or be served. The Draft General Plan does include a potential restriction on <br />drive-through establishments. This issue was a concern to the property owner <br />prior to his application. In fact, this issue was brought before the City Council to <br />obtain the Council's input regarding the construction of a drive-through restaurant <br />on this site. The Council indicated that since there are no current prohibitions of <br />drive-through restaurants and until this issue is reviewed and analyzed as part of <br />the General Plan process, the applicant was free to apply for the required <br />approvals. <br /> <br />Increased emissions due to a drive-through restaurant is primarily a function of <br />the efficiency of the drive-through service. The proposed drive-through has <br />incorporated two windows (a pay window and a pick-up window) and two reader <br />boards. The proposed drive-through will be extremely efficient and would not <br />create additional emissions. <br /> <br />C. That the proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />As proposed and conditioned, the use complies with all applicable regulations of <br />the zoning district and the PUD in which it is located. <br /> <br />WHEREAS, the Planning Commission determined that the proposed project would be an <br />attractive and compatible addition to Hacienda Business Park. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />
