Resolution No. PC-96-09
Page 2

B. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or materially injurious to the properties or
improvements in the vicinity.

The project's design, location, and conditions of approval will result in it being
operated in a non-nuisance, safe manner. Other drive-through restaurants within
the City operate satisfactorily under similar conditions. Staff has added a standard
use permit condition of approval which allows the Planning Commission to
reconsider the use permit approval to address any unforeseen nuisances.

The entrance to the drive-through lane would be clearly marked and would not
interfere with on- or off-site traffic patterns. There is adequate stacking within
the drive-through lane which will help preclude conflicts with adjacent parking
spaces and on-site traffic movements.

Any drive-through establishment is a potential source of air emissions,
particularly carbon monoxide, due to cars idling while customers are waiting to
order or be served. The Draft General Plan does include a potential restriction on
drive-through establishments. This issue was a concern to the property owner
prior to his application. In fact, this issue was brought before the City Council to
obtain the Council's input regarding the construction of a drive-through restaurant
on this site. The Council indicated that since there are no current prohibitions of
drive-through restaurants and until this issue is reviewed and analyzed as part of
the General Plan process, the applicant was free to apply for the required
approvals.

Increased emissions due to a drive-through restaurant is primarily a function of
the efficiency of the drive-through service. The proposed drive-through has
incorporated two windows (a pay window and a pick-up window) and two reader
boards. The proposed drive-through will be extremely efficient and would not
create additional emissions.

C. That the proposed conditional use will comply with each of the applicable
provisions of this chapter.

As proposed and conditioned, the use complies with all applicable regulations of
the zoning district and the PUD in which it is located.

WHEREAS, the Planning Commission determined that the proposed project would be an
attractive and compatible addition to Hacienda Business Park.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES THE FOLLOWING:
