PC-2024-19 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION FOR CONDITIONAL USE PERMIT (CUP), DESIGN <br />REVIEW (DR), AND SIGN DESIGN REVIEW (SDR) FOR PHILZ COFFEE LOCATED AT <br />1803 SANTA RITA ROAD, AS FILED UNDER CASE NOS. P24-0670, -0671, AND -0672 <br />WHEREAS, on October 17, 2024, Patti Nelson, representing Philz Coffee, applied for <br />CUP, DR, and SOR approval to operate a drive-through coffee restaurant within an existing <br />commercial building located at 1803 Santa Rita Road (hereinafter "project"); and <br />WHEREAS, the subject property is zoned PUD-C (Planned Unit Development - <br />Commercial) and HOZ (Housing Opportunity Zone) Districts; and <br />WHEREAS, a drive-through coffee restaurant is a conditionally permitted use in the <br />subject's zoning district and requires Planning Commission approval of a CUP; and <br />WHEREAS, on December 11, 2024, the Planning Commission held a duly-noticed <br />public hearing and considered relevant exhibits, recommendations of the City staff concerning <br />this application, and received testimony from the applicant and interested parties. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, includ ing the oral and written staff <br />reports and all public comment and testimony: <br />Section 1: Findings for California Environmental Quality Act (CEQA) <br />With respect to CEQA, the Planning Commission finds the project is categorically exempt from <br />CEQA pursuant to CEQA Guidelines Section 15301, Class 1, Existing Facilities. The proposed <br />use will operate in an existing building with an existing drive-through lane and only minor <br />exterior modifications ( color change and signage) are proposed. <br />Section 2: Findings for Conditional Use Permit Approval <br />With respect to the approval of P24-0291 , the Planning Commission makes the following <br />findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the <br />site is located. <br />Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient , <br />workable relationship among land uses , protect existing land uses from inharmonious <br />influences and harmful intrusions, and to ensure that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The subject site follows the uses of the PMC's C-C District. The PMC permits <br />restaurants in the C-C District with any restaurant that includes a drive -through being <br />subject to a CUP.
