Page 1 <br />EXHIBIT A <br />DRAFT CONDITIONS OF APPROVAL <br />P23-0605: VTM 8676 <br />2025 Santa Rita Road <br />November 8, 2023 <br />The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and <br />maintain compliance with the conditions of approval below. Where approval by the Director of <br />Community Development, Planning Division, Director of Engineering/City Engineer, City <br />Attorney, Chief Building and Safety Official, Fire Department or other City staff is required, <br />review shall be for compliance with all applicable conditions of approval, adopted policies and <br />guidelines, ordinances, laws and regulations, and accepted practices related to the approval. In <br />addition to complying with the conditions below, the applicant is required to comply with all <br />applicable federal, state, and local laws that pertain to this project whether or not specifically <br />noted herein. <br />This approval is granted for P23-0605, Vesting Tentative Map 8676 approval pursuant to SB 330 <br />to 1) demolish an existing motel; 2) construct a housing development consisting of 42 three- <br />story townhome style condominiums ranging in size from approximately 1,400 to 2,150 square <br />feet and related site improvements; and 3) Vesting Tentative Map located on Assessor Parcel <br />No(s). 946-3295-001-04 at 2025 Santa Rita Road. Development shall be substantially as shown <br />on the project materials listed below: <br />a. Civil Plans, Exhibit B, prepared by C&V for City Ventures, dated “Received” on <br />August 31, 2023, and kept on file in the Planning Division of the Community <br />Development Department. <br />The project materials listed above are collectively the “Approved Plans”. <br />THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPROVAL AND REVISIONS: The proposed development shall be in substantial <br />conformance with the “Approved Plans”, except as modified by the following conditions. <br />Minor changes to the plans may be allowed subject to the approval of the Director of <br />Community Development if found to be in substantial conformance with the approved <br />exhibits. Planning Division approval is required before any changes are implemented in <br />site design, grading, architectural design, building colors or materials, green building <br />measures, landscape material, etc. <br />2. EXPIRATION – The approval shall lapse and shall be void 2 years following the effective <br />date of approval of the vesting tentative map application, unless: (1) a final map is <br />approved before the vesting tentative map expires or (2) the applicant has filed a request <br />for: a vesting tentative map extension per Section 19.22.070.D.2, of the PMC. The <br />vesting tentative map shall expire as provided in Section 19.22.070 of the PMC. <br />3. CONDITIONS OF APPROVAL CHECKLIST: The applicant shall submit a “Conditions of <br />Approval Checklist” indicating all conditions in Exhibit A have been satisfied, <br />incorporated into the building permit plans or improvements plans, and/or addressed. <br />EXHIBIT A <br />ATTACHMENT 1
