17 <br /> THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTON,, <br /> March 21, 2023 <br /> Police <br /> TITLE: (1) RECEIVE ANNUAL MILITARY EQUIPMENT USE REPORT FOR 2022; <br /> (2) INTRODUCE AND WAIVE FIRST READING OF AN ORDINANCE <br /> AMENDING ORDINANCE NO. 2238 TO AMEND THE PLEASANTON <br /> POLICE DEPARTMENT'S MILITARY EQUIPMENT USE POLICY TO ADD <br /> EQUIPMENT TO THE POLICY'S MILITARY EQUIPMENT INVENTORY; <br /> AND (3) ADOPT A RESOLUTION ACCEPTING THE ANNUAL MILITARY <br /> EQUIPMENT USE REPORT FOR 2022; DETERMINING THAT THE <br /> POLICE DEPARTMENT'S USE OF MILITARY EQUIPMENT IN 2022 <br /> COMPLIED WITH THE STANDARDS OF APPROVAL; AND RENEWING <br /> THE MILITARY EQUIPMENT USE POLICY <br /> SUMMARY <br /> Assembly Bill 481, codified as Government Code sections 7070 through 7075, requires <br /> a law enforcement agency to obtain approval from the City Council, by adoption of a <br /> military equipment use policy by ordinance, prior to funding, acquiring, or using military <br /> equipment as defined in the law. The law further states the governing body shall review <br /> the ordinance that it has adopted pursuant to this section annually and vote to renew <br /> the ordinance at a regular meeting. <br /> STAFF RECOMMENDATION <br /> (1) Introduce and waive first reading of an ordinance amending Ordinance No. 2238 to <br /> amend the Pleasanton Police Department's Military Equipment Use Policy to add <br /> equipment to the policy's military equipment inventory; and (2) Adopt a resolution <br /> accepting the Annual Military Use Report for 2022 determining that the Pleasanton <br /> Police Department's use of military equipment in 2022 complied with the standards of <br /> approval, and renewing the Military Equipment Use Report. <br /> FINANCIAL STATEMENT <br /> There are no anticipated fiscal impacts. The staff time to facilitate the requirements of <br /> AB481 will be absorbed into the work of existing staff. <br />
