RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING <br />OBJECTIVE DESIGN STANDARDS FOR QUALIFYING HOUSING DEVELOPMENTS <br />(CASE NO. P20-0989) <br /> <br /> <br />WHEREAS, a number of recent state laws limit review by local jurisdictions on qualifying <br />housing projects to standards that are objective and uniformly verifiable, involving no personal or <br />subjective judgement and are instead based on a uniform benchmark or criterion available and <br />knowable by both the project proponent and the City prior to submittal of the housing application; <br />and <br /> <br />WHEREAS, the Housing Accountability Act, Cal. Government Code section 65589.5, <br />restricts the City of Pleasanton’s ability to deny or reduce the density of all housing development <br />projects that are consistent with objective development standards; and <br /> <br />WHEREAS, the City of Pleasanton seeks to adopt Objective Design Standards to comply <br />with recent State legislation, implement streamlined review processes for qualifying housing <br />projects at the density permitted on the site and proposed by the development in accordance with <br />State law, ensure that these projects align with the City’s expectations and vision to maintain and <br />support the character of Pleasanton, provide a set of clear criteria to guide development, and <br />establish an objective framework by which a qualifying project will be evaluated; and <br /> <br />WHEREAS, such Objective Design Standards will be applicable to qualifying housing <br />development projects, as defined by the Housing Accountability Act, and as mandatory standards <br />applicable to all qualifying projects in accordance with State law; and <br /> <br />WHEREAS, the Objective Design Standards are generally based upon the body of <br />regulations already contained in adopted City planning documents and the Pleasanton Municipal <br />Code, and will complement such existing adopted policy documents in furtherance of the goals, <br />policies, and actions of the General Plan, which encourage high quality design and the quality of <br />life that an enhanced built environment fosters; and <br /> <br />WHEREAS, on January 11, 2023, staff provided the Planning Commission with Objective <br />Design Standards for Qualifying Housing Developments (Case No. P20-0989); and <br /> <br />WHEREAS, on January 11, 2023, the Planning Commission held a duly noticed public <br />hearing and considered the written agenda report, relevant exhibits, recommendations of City <br />staff, and received testimony from interested parties and provided a favorable recommendation <br />of Resolution PC-2023-4 to the City Council regarding the Objective Design Standards for <br />Housing Element Sites; and <br /> <br />WHEREAS, on January 26, 2023, the City Council held a duly noticed public hearing and <br />considered the Objective Design Standards for residential projects in the R-M, M-U, and C-C <br />Districts under Case No. P20-0989 to establish objective design standards for residential <br />development in Pleasanton, as set forth in the written agenda report, relevant exhibits, <br />recommendations of City staff and the Planning Commission, and received testimony from <br />interested parties regarding the Objective Design Standards; and <br /> <br />WHEREAS, the Objective Design Standards implement the policies and programs of the <br />2023-2031 (6th Cycle) Housing Element Update considered in the Program Environmental Impact <br />ATTACHMENT 1
