RESOLUTION NO. PC-2021-18 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br /> PLEASANTON RECOMMENDING THAT THE CITY COUNCIL APPROVE THE <br /> APPLICATIONS FOR A PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT <br /> PLAN AND VESTING TENTATIVE SUBDIVISION MAP FOR A 25-LOT <br /> RESIDENTIAL PROJECT LOCATED ON A VACANT PARCEL WITH APN NO. 949- <br /> 16-6, AS FILED UNDER CASES PUD-138 AND VESTING SUBDIVISION TENTATIVE <br /> MAP 8616; AND FIND THAT THE PROJECT IS CONSISTENT WITH THE HAPPY <br /> VALLEY SPECIFIC PLAN EIR AND ZONING <br /> WHEREAS, on October 12, 2020, Martin lnderbitzen on behalf of the property <br /> owner AVS Ranch LLC ("Applicant") submitted applications to develop an approximately <br /> 112-acre vacant site (APN 949-16-6) for: (1) PUD development plan approval for a 25- <br /> lot development (22 single-family residential and 3 open space lots) with related on- and <br /> off-site improvements; and (2) Vesting Tentative Subdivision Map approval to subdivide <br /> the parcel ("Project"); and <br /> WHEREAS, the site is designated Low Density Residential and Open Space in <br /> the General Plan; and <br /> WHEREAS, the site is located within the 1998 City Council adopted Happy <br /> Valley Specific Plan (HVSP) area, and is identified as Lot 98 by the HVSP; and <br /> WHEREAS, the site is designated Planned Unit Development— Semi-Rural <br /> Residential/Agricultural/Open Space (PUD-SRDR/A/OS) Districts by the HVSP; and <br /> WHEREAS, the proposed development is located within the Spotorno Flat Area <br /> of Lot 98; and <br /> WHEREAS, HVSP Environmental Impact Report (EIR), certified by the City in <br /> 1998 (State Clearinghouse No. 97032034, certified June 16, 1998) (1998 HVSP Final <br /> EIR), evaluated the potential environmental impacts associated with construction of 22 <br /> dwelling units in the Spotorno Flat Area; and <br /> WHEREAS, an Initial Study/Consistency Checklist was analyzed pursuant to <br /> California Environmental Quality Act (CEQA) Guidelines Sections 15182 and 15183 <br /> determine whether and to what extent the 1998 HVSP FEIR addresses the potential <br /> impacts of the Project; and <br /> WHEREAS, the prepared Initial Study/Consistency Checklist found that the <br /> Project is consistent with the 1998 HVSP FEIR, listed mitigation measures identified in <br /> the 1998 HVSP FEIR that apply to the development of the Spotorno Flat Area, and <br /> determined that no further environmental review is required; and <br /> WHEREAS, the Project site contains a 16.5-foot public road easement deeded <br /> by the property owners to the County of Alameda in 1927; and <br />h the additional trips upon receipt of a written <br /> notice from the City and/or have their use permit brought back to Planning Commission <br /> for subsequent review (Project Specific Condition) <br /> P20-0596 Planning Commission <br /> Page 3 of 4 <br />UP for <br /> the proposed use would be consistent with the City's ability to regulate zoning as <br /> listed in Chapter 18.124 of the Municipal Code. In addition, the Planning <br /> Commission finds that, as conditioned, the proposed use will comply with all <br />reas in <br /> Pleasanton.
