Resolution No. PC-2021-18 <br /> Page Two <br /> WHEREAS, on November 3, 2021, the City notified utility agencies of the City's <br /> intent to vacant the unused portions of this easement; and <br /> WHEREAS, on November 15, 2021, Notice of Public Hearing for the proposed <br /> development were sent to interested parties and property owners/residents; and <br /> WHEREAS, on December 8, 2021, the Planning Commission, following public <br /> notice, conducted a public hearing where it considered the written agenda report, public <br /> testimony, and related project materials. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br /> of Pleasanton, based on the entire record of proceedings, including the oral and written <br /> agenda reports and all public comment and testimony: <br /> Section 1: The Planning Commission finds that the Project is consistent with the 1998 <br /> HVSP and its Final Environmental Impact Report (FEIR) and will not have a significant <br /> effect on the environment and therefore recommends the City Council adopt the Initial <br /> Study/Consistency Checklist (Exhibit B) prepared for the Project and require the Project <br /> to comply with the mitigation measures listed therein. <br /> Section 2: With respect to the Planned Unit Development application, PUD-138, the <br /> Planning Commission makes the following findings and determinations with respect to <br /> each of the considerations for approval of a PUD Development Plan as required by <br /> Section 18.68.110 of the Pleasanton Municipal Code (PMC): <br /> 1. Whether the plan is in the best interests of the public health, safety, and <br /> general welfare: <br /> The Planning Commission recommends that the City Council find that the <br /> proposed Project, as conditioned, meets all applicable City standards concerning <br /> public health, safety, and welfare. The subject development would include the <br /> installation of all required on-site utilities with connections to municipal systems in <br /> order to serve the new lots. The Project would be compatible with the adjacent <br /> uses and the design criteria listed in the design guidelines, which would require <br /> new homes to be constructed consistent with the existing residential scale and <br /> character of the area. Adequate setbacks have been required between the new <br /> dwellings and the existing structures on the adjacent properties. The Project will <br /> not generate volumes of traffic that cannot be accommodated by existing streets <br /> and intersections in the area. The proposed homes will be designed to meet the <br /> requirements of the California Building Code, California Fire Code, and other <br /> applicable codes. As such, the Commission recommends that the City Council <br /> conclude that this finding can be made. <br />596 Planning Commission <br /> Page 3 of 4 <br />UP for <br /> the proposed use would be consistent with the City's ability to regulate zoning as <br /> listed in Chapter 18.124 of the Municipal Code. In addition, the Planning <br /> Commission finds that, as conditioned, the proposed use will comply with all <br />reas in <br /> Pleasanton.
