PC-97-01 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF GINA SAMSEL D.B.A. THE <br />PLEASANTON SPA FOR A CONDITIONAL USE PERMIT, AS FILED UNDER <br />CASE UP-96-83 <br /> <br />WHEREAS, Gina Samsel d.b.a. The Pleasanton Spa, has applied for a conditional use permit to <br />operate a therapeutic massage facility within a day spa located at 3059 Hopyard <br />Road, Suite J and K; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C-C (Central <br />Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 8,1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location ofthe conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site <br />is located. <br /> <br />Some of the objectives of the zoning ordinance are to foster a harmonious, <br />convenient, workable relationship among land uses, protect existing land uses from <br />inharmonious influences and harmful intrusions, and to insure that public and <br />private lands are used for the purposes which are most appropriate and beneficial <br />to the City as a whole. One of the purposes of the commercial zoning district is to <br />provide locations which offer commodities and services to the residents of <br />Pleasanton and the surrounding areas. <br /> <br />As proposed, the use would be compatible with the current mix of commercial and <br />office uses in the shopping center. The proposed project will be consistent with the <br />above listed objectives of the zoning ordinance and will not interfere with the <br />operations of the surrounding uses. The proposed use would provide a service <br />available to the community and would add to the economic vitality of the Hopyard <br />Village Shopping Center, possibly contributing patronage to the other businesses. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />heath, safety, or welfare, or materially injurious to the properties or improvements <br />in the vicinity. <br />
