Resolution No. PC-97-01 Page 2 Given the professional nature of the proposed use, the proposed hours of operation, the projected number of clients, and the size of the business, the massage studio will not create negative impact on the surrounding tenants or residences. No alterations to the existing design of the building are proposed, and there is adequate off-street parking to meet project demand. Professional massage operations tend to be quiet and will not subject surrounding uses to heavy truck traffic, hazardous odors, or other objectionable influences. The conditions of approval of the use permit, including registration with the Police Department, will ensure that the establishment remains within the standards of all applicable City codes. C. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The site's PUD-C-C zoning conditionally permits the establishment of massage facilities. The proposed use complies with all relevant sections ofthe zoning ordinance. Granting a conditional use permit to operate a therapeutic massage facility is consistent with the City's ability to regulate zoning as listed in Municipal Code Section 18.124 "Conditional Uses." WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); therefore, no environmental document was prepared for this project. WHEREAS, the Planning Commission determined that the proposed massage facility will be situated to provide a safe and nuisance-free environment for patrons, users, and adjacent property owners. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Section 2. Approves Case UP-96-83, the application of Gina Samsel d.b.a. The Pleasanton Spa, for a conditional use permit to operate a therapeutic massage facility within a day spa located at 3059 Hopyard Road, Suite J and K, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
