PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-13 <br />RESOLUTION DENYING CASE PAP-23, THEREBY UPHOLDING THE ZONING <br />ADMINISTATOR'S DENIAL OF CASE PV-83/PADR-736, THE APPLICATION OF <br />BRETT L. HOFFMAN <br />WHEREAS, on April 3, 2003, the Zoning Administrator denied the application of Brett L. <br />Hoffmann for a variance from the Municipal Code and for administrative design <br />review to allow an existing approximately 10.5-foot high, 107-square-foot shed <br />attached to the western side of the existing residence with azero-foot setback where <br />a minimum of five feet is required, and with an aggregate side yard setback of ten <br />feet, seven inches, where a minimum of 12 feet is required, for the property located <br />at 7356 Maywood Drive; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant submitted <br />an appeal of the Zoning Administrator's decision; <br />WHEREAS, at its duly noticed public hearing of April 23, 2003, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature aze categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission determined that (1) the subject lot does not exhibit any <br />special circumstances unique to the site depriving the property of privileges <br />enjoyed by other similarly situated and zoned properties; (2) the proposal would <br />constitute a grant of special privilege; and (3) this request would jeopardize the <br />health, safety, and general welfare of the surrounding area. <br />
