PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-11 <br />RESOLUTION APPROVING THE APPLICATION OF PAUL ZAMPIERIN <br />WITH BENDALL METAL PRODUCTS FOR CONDITIONAL USE PERMIT <br />APPROVAL, AS FILED UNDER CASE PCUP-77 <br />WHEREAS, Paul Zampierin with Bendall Metal Products has applied for a conditional <br />use permit to allow a thin gauge metal cutting and bending business within <br />the existing building located at 1048 Serpentine Lane, Suite 310 (Valley <br />Business Park); and <br />WHEREAS, zoning for the property is PUD-I (Planned Unit Development -Industrial) <br />District; and <br />WHEREAS, at its duly noticed public hearing of April 9, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The subject building is located in Valley Business Park which has <br />characteristics of the City's Industrial Park (I-P) zoning district. The use <br />would generate some noise, which would not be atypical for a light <br />industrial use such as that proposed. As conditioned, hours of operation at <br />Bendall Metal Products would be restricted so as not to create noise <br />impacts on the Pleasanton Playhouse's operations. As proposed there <br />would be three or fewer employees, customers would rarely come to the <br />site, and inbound and outbound deliveries would only occur a few times a <br />week; therefore, the use would not create parking or circulation impacts. <br />2. The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The business is a light industrial use in an area designated for light <br />industrial activities. The applicant would be required to receive all <br />
