PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-24 <br />RESOLUTION APPROVING THE APPLICATION OF CHIEWHO LIN, WELCOME <br />MARKET, INC., FOR DESIGN REVIEW APPROVAL AND CONDITIONAL USE <br />PERMIT, AS FILED UNDER CASE PDR-849/PCUP-242 <br />WHEREAS, Chien -Ho Lin, Welcome Market, Inc., has filed for an application for <br />Design Review approval and a Conditional Use Permit to modify the <br />building facade and to operate a "99 Ranch Market" at 4299 Rosewood <br />Drive; and <br />WHEREAS, zoning for the property is C -C (Central Commercial) District; and <br />WHEREAS, at its duly noticed public hearing of July 22, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act (CEQA) Guidelines, Section 15301, <br />Existing Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings for the conditional <br />use permit: <br />1. The location of the proposed conditional use is in accordance with <br />the objectives of the Zoning Ordinance and the purpose of the <br />district in which the site is located. <br />The objectives of the zoning ordinance include protecting existing land use <br />from inharmonious influences and harmful intrusions; fostering <br />harmonious, convenient, workable relationships among land uses; and <br />ensuring that public and private lands ultimately are used for the purposes <br />which are most appropriate and beneficial to the City as a whole. <br />The site of the proposed supermarket is located in the Rose Pavilion <br />Shopping Center, which permits a variety of uses listed in the C -C (Central <br />Commercial) District, such as retail, personal service, and restaurant uses. <br />Operating a supermarket in this shopping center would be consistent with <br />the purposes of the C -C zoning district by offering commodities and <br />services to residents of the surrounding residential neighborhood and <br />other Pleasanton residents and employees working in nearby businesses. <br />The proposed conditions of approval would give the City the appropriate <br />
