The Conditional Use Permit for <br />the supermarket, as proposed, would be consistent with the objectives of <br />the zoning district, and, therefore, this finding can be made. <br />2. The proposed location of the conditional use and the conditions <br />under which the conditional uses would be operated or maintained <br />will not be detrimental to the public health, safety, or welfare, or <br />materially injurious to the properties or improvements in the vicinity. <br />The traffic study prepared by Kimley-Horn determined that the proposed <br />use increases trip volume during peak hours, but levels of service at <br />nearby intersections are within the General Plan standards. The City <br />Traffic Engineer concluded that the additional trips in the peak hours, <br />especially during the PM peak hours, could be alleviated through adjusting <br />the timing of the traffic signals on Santa Rita Road at Rosewood Drive. <br />As proposed, the grocery store would have regular retail business hours. <br />As conditioned, deliveries would generally be completed prior to the store <br />opening in the morning. The existing tenant space is located <br />approximately 190 feet from residential properties, and the existing <br />ingress/egress to and from the shopping center would continue to provide <br />easy access for shopping center patrons. As conditioned, the proposed <br />use would not detrimentally impact the surrounding properties, and, <br />therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />The proposed use, as conditioned, would comply with applicable <br />provisions of the zoning ordinance regarding type of use allowed in the <br />C -C district, parking, circulation, and other requirements. Granting a <br />Conditional Use Permit to the applicant would be consistent with the City's <br />ability to regulate zoning as listed in the Municipal Code. Therefore, this <br />finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area, and <br />the conditional use would be compatible with the existing uses in the area. <br />
