} <br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-22 <br />RESOLUTION APPROVING VESTING TENTATIVE TRACT MAP 9687, <br />THE APPLICATION OF CLANCY DUTRA, DUTRA TRUST <br />WHEREAS, Clancy Dutra, Dutra Trust, has applied for Vesting Tentative Tract Map <br />approval to subdivide an existing lot located at 1053 Happy Valley Road <br />into five residential lots and one open space lot; and <br />WHEREAS, The subdivision map is submitted in conformance to the previously <br />approved application, PUD -77; and <br />WHEREAS, zoning for the property is PUD-SRDR/OS (Planned Unit Development — <br />Semi -Rural Density Residential/Open Space) District; and <br />WHEREAS, at its duly noticed public hearing of July 8, 2009, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of <br />the City staff concerning this application; and <br />WHEREAS, the environmental effects of this project was reviewed at the PUD stage, <br />and a Negative Declaration was adopted; further, there is neither new <br />information nor changed circumstance to trigger further environmental <br />review; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The proposed map substantially conforms to the zoning <br />regulations/development plan. <br />The map's design and improvements are consistent with the development <br />plan and conditions of PUD -77. Therefore, this finding can be made. <br />2. The design of the subdivision provides, to the extent feasible, for <br />future passive or natural heating or cooling opportunities. <br />Being a development with varying topography and limited building <br />envelopes, some, but not all, of the lots would accommodate situating the <br />future homes on an east -west alignment for southern exposure. The <br />homes in this project will be required to comply with the City's residential <br />Green Building Ordinance, which requires that each home achieve a <br />minimum of 50 "Green Home" points on Alameda County Waste <br />Management Authority's "Single -Family Green Building Rating System." <br />
