PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-19 <br />RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT <br />AGREEMENT FOR THE STAPLES RANCH PROJECT <br />WHEREAS, Government Code Section 65865 through Section 65869.5 authorize cities <br />and counties to enter into binding agreements with persons having legal or <br />equitable interests in real property for the development of such property; <br />and <br />WHEREAS, on February 24, 2009, the Stoneridge Drive Specific Plan <br />Amendment/Staples Ranch was adopted by the City of Pleasanton, <br />specifying the design and construction of the extension of Stoneridge <br />Drive, all Stoneridge Drive roadway improvements, all public utility <br />extensions within and adjacent to Staples Ranch, and funding for any <br />off-site traffic improvements required as a result of the extension of <br />Stoneridge Drive to EI Charro Road; and <br />WHEREAS, development plans for various properties are being processed, including <br />those of Hendrick Automotive Group (PUD -57), Continuing Life <br />Communities (PUD -68), and San Jose Arena Management (PUD -70); and <br />WHEREAS, Alameda County Surplus Property Authority has applied for a <br />development agreement with the City of Pleasanton to initiate annexing <br />the property into Pleasanton; to protect the property owner's vested rights <br />to reserve water and sewer capacity for the project; and to construct <br />certain improvements to the 1-580/EI Charro Road interchange if the City <br />of Livermore has not already done so, in exchange for the construction of <br />the Stoneridge Drive Extension improvements, defined as a four -lane <br />divided public right-of-way from its current terminus at Trevor Parkway to <br />EI Charro Road, with turn lanes and two two-lane bridges across the <br />Arroyo Mocho; to pay to the City one million dollars for the City's <br />construction of off-site traffic improvements to address the off-site effects <br />of the extension of Stoneridge Drive; to provide for the preservation of the <br />San Joaquin Spearscale Habitat; and to fund public art; and <br />WHEREAS, at its duly noticed public hearing of June 24, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />
