PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-13 <br />RESOLUTION APPROVING A CONDITIONAL'USE PERMIT FOR <br />VALLEY COMMUNITY CHURCH, AS FILED UNDER CASE PCUP-239 <br />WHEREAS, Valley Community Church has applied for a Conditional Use Permit to <br />increase the number of students at an existing preschool and to add a <br />summer preschool program at Valley Community Church located at <br />4455 Del Valle Parkway; and <br />WHEREAS, zoning for the property is P (Public and Institutional) District; and <br />WHEREAS, at its duly noticed public hearing of April 29, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act (CEQA) Guidelines, Section 15301, <br />Existing Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />The objectives of the Public and Institutional District zoning of the property include the <br />orderly establishment of public or quasi -public facilities and expansion of their <br />operations. The zoning ordinance endeavors to foster a harmonious, convenient, <br />workable relationship among land uses, protect land uses from inharmonious influences <br />and harmful intrusions, promote a safe, effective traffic circulation system, and ensure <br />that public and private lands ultimately are used for the purposes which are most <br />appropriate and beneficial to the City as a whole. <br />The operation of the preschool is consistent with these objectives in that the existing <br />school has been in operation for over ten years, and there have been no formal <br />complaints reported to the City. The proposed operation through the summer months <br />.and the additional children during the school year will not generate a substantial amount <br />of traffic or noise. Only a morning session is proposed during the summer, and the <br />number of children is limited. Additionally, since the high school is not in full session, <br />there is less traffic in the neighborhood overall. Furthermore, the applicant may be <br />required to mitigate future nuisances created by the proposed use. Therefore, this <br />finding can be made. <br />
