The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />For the past ten years, the preschool has been a "good neighbor" to the surrounding <br />neighbors since no formal complaints have been reported to the City. The applicant <br />now requests to expand this use to the summer months by establishing a morning <br />session. The proposed hours of operation are shorter, and the school will serve fewer <br />children than during the school year. The operation of the preschool during the school <br />year will be consistent with the current operation in that the number of children playing <br />outside at any one time will be limited to reduce noise and impact on the neighbors. <br />Additionally, staggered start and end times during the school year will allow for sufficient <br />parking and circulation on the property. The drive aisles on the property also provide <br />safe ingress and egress to the facility. The proposed Conditions of Approval will ensure <br />that the applicable provisions of the Municipal Code are met for the increase in the <br />number of children during the school year. Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The Municipal Code states that because of their unusual circumstance, conditional uses <br />require special consideration so that they may be located properly with respect to their <br />effects on surrounding properties. The preschool has been in operation for over ten <br />years, and the current proposal is to allow for summertime operation and to increase the <br />number of children during the school year. The proposal to operate the school during <br />the summer months is less intense in the hours and the number of children who are <br />present at the preschool during the school year. The proposed Conditions of Approval <br />will ensure that the applicable provisions of the Municipal Code are met for the increase <br />in the number of children during the school year. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-239, the application of Valley Community Church <br />for a Conditional Use Permit to increase the number of students at an <br />existing preschool and to add a summer preschool program at Valley <br />Community Church located at 4455 Del Valle Parkway, subject to the <br />conditions shown in Exhibit A, attached hereto and made part of this case <br />by reference. <br />
