J <br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-16 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR JANNY ROCHA, <br />AS FILED UNDER CASE PCUP-205 <br />WHEREAS, Janny Rocha has applied for a Conditional Use Permit to relocate and <br />replace the 5,000 -gallon wood tank with a new 5,000 -gallon polytank in <br />the rear yard of the existing residence located at 481 Sycamore Road; and <br />WHEREAS, zoning for the property is PUD -A (Planned Unit Development — <br />Agriculture); and <br />WHEREAS, at its duly noticed public hearing of April 9, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, existing facilities consisting of the operation, permitting, licensing, or minor <br />alteration of structures involving no expansion of use beyond that existing <br />are categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA), Section 15303, Class 1; furthermore, <br />an Environmental Impact Report (EIR) for the North Sycamore Specific <br />Plan was approved by'the City Council on June 16, 1992, and the EIR <br />anticipate the use of wells and in turn water tanks on existing <br />non-developed sites such as that proposed; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location 'of.the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site' is <br />located. <br />The request to replace and relocate the water tank conforms to the purpose and <br />objectives of the Zoning Ordinance and the North Sycamore Specific Plan. While there <br />are no established site development standards for the lot, the Agricultural zoning district <br />standards are considered to be the applicable development standards for this lot. The <br />tank conforms to the Agricultural zoning district standards and applicable Specific Plan; <br />therefore, this finding can be made. <br />
