The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />The replaced and relocated water tank would not be detrimental to the public health, <br />safety, and general welfare, or materially injurious to properties or improvements in the <br />vicinity. The project has been reviewed by other City Departments/Divisions, and they <br />do not require any additional permits or review. Although the neighbor has visual <br />concerns with the location of the tank, the project's location and generous setbacks <br />form the rear and side property lines would not negatively impact properties in the <br />immediate vicinity of the site. The applicant has stated her willingness to add additional <br />mitigation measures, within reasons and without relocating the tank, in order to address <br />the neighbor's visual concerns. Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The replaced water tank would be located in the rear yard of the site and significantly <br />screened by redwood trees. The tank is substantially set back from the side and rear <br />yard property lines. The conditional use will comply with each of the applicable <br />standards of the Code, and, therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-205, the application of Janny Rocha for a <br />Conditional Use Permit to relocate and replace the 5,000 -gallon wood tank <br />with a new 5,000 -gallon polytank in the rear yard of the existing residence <br />located at 481 Sycamore Road, subject to the conditions shown in <br />Exhibit B, attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
