The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The replaced and relocated water tank would not be detrimental to the public health, safety, and general welfare, or materially injurious to properties or improvements in the vicinity. The project has been reviewed by other City Departments/Divisions, and they do not require any additional permits or review. Although the neighbor has visual concerns with the location of the tank, the project's location and generous setbacks form the rear and side property lines would not negatively impact properties in the immediate vicinity of the site. The applicant has stated her willingness to add additional mitigation measures, within reasons and without relocating the tank, in order to address the neighbor's visual concerns. Therefore, this finding can be made. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The replaced water tank would be located in the rear yard of the site and significantly screened by redwood trees. The tank is substantially set back from the side and rear yard property lines. The conditional use will comply with each of the applicable standards of the Code, and, therefore, this finding can be made. WHEREAS, the Planning Commission determined that the proposed conditional use would be compatible with the existing uses in the area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-205, the application of Janny Rocha for a Conditional Use Permit to relocate and replace the 5,000 -gallon wood tank with a new 5,000 -gallon polytank in the rear yard of the existing residence located at 481 Sycamore Road, subject to the conditions shown in Exhibit B, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
